Democrats captured the White House and substantially improved their majorities in the U.S. Senate and House of Representatives during Tuesday’s national elections. President-elect Barack Obama and his team plan to move quickly with a transition plan, with key cabinet positions possibly being announced as early as next week.
EPA Issues Advance Notice of Proposed Rulemaking on Greenhouse Gas Regulation

The Environmental Protection Agency (EPA) issued an Advance Notice of Proposed Rulemaking (ANPR) requesting public comment on whether and how the Agency should regulate emissions of greenhouse gases using its authority under the Clean Air Act. While further EPA action on this subject during the current presidential administration appears quite unlikely absent specific direction from Congress or the judiciary, the request for public comment on the ANPR is an important opportunity for entities that could be affected by future GHG regulations to provide input to the regulatory process.

Supreme Court Holds EPA Must Consider States’ Request for Climate Change Rule

On April 2nd, the Supreme Court decided its first climate change case and held that (1) a group of states have standing to challenge the Environmental Protection Agency’s (EPA) denial of their petition under the Clean Air Act for a rule regulating greenhouse gas (GHG) emissions from new motor vehicles, (2) that the Agency has the statutory authority to issue such a rule, and (3) that EPA’s rejection of the rulemaking petition was arbitrary and capricious.
